{"id":395,"date":"2017-06-19T21:54:47","date_gmt":"2017-06-19T21:54:47","guid":{"rendered":"http:\/\/dev2.berenbaumlaw.com\/?page_id=395\/"},"modified":"2017-06-19T21:54:47","modified_gmt":"2017-06-19T21:54:47","slug":"r-visa-religious-workers","status":"publish","type":"page","link":"https:\/\/berenbaumlaw.com\/en\/practice-areas\/r-visa-religious-workers\/","title":{"rendered":"R Visa: Temporary Nonimmigrant Religious Workers"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><p>[vc_row][vc_column][vc_custom_heading text=&#8221;R Visa: Temporary Nonimmigrant Religious Workers&#8221; use_theme_fonts=&#8221;yes&#8221;][separator width=&#8221;20px&#8221; height=&#8221;1px&#8221; color=&#8221;#660030&#8243; margin_top=&#8221;20px&#8221; margin_bottom=&#8221;20px&#8221;][vc_column_text]The R-1 classification is designed for foreign nationals coming to the U.S. temporarily to be employed at least part time (average of at least 20 hours per week) by a non-profit religious organization in the U.S. to work as a minister or in a religious vocation or occupation.<\/p>\n<h4>Requirements<\/h4>\n<p>To qualify for the R-1 visa:<\/p>\n<ul>\n<li>The applicant must be a member of a religious denomination having a bona fide nonprofit religious organization in the U.S.;<\/li>\n<\/ul>\n<ul>\n<li>The religious denomination and its affiliate are either exempt from taxation or qualifies for tax-exempt status; and<\/li>\n<\/ul>\n<ul>\n<li>The applicant has been a member of the denomination for two years immediately preceding applying for religious worker status.<\/li>\n<\/ul>\n<h4>Period of Stay<\/h4>\n<p>The R-1 classification may be granted for up to 30 months and may be for up to an additional 30 months.\u00a0 The total stay in the U.S. in an R-1 status cannot exceed 60 months (5 years).<\/p>\n<p>All the time spent outside the U.S. is subtracted and does not count toward the five-year period. As such, the time out of the U.S. may be recaptured to the five years.<\/p>\n<p>Additionally, if an R-1 holder remains outside the U.S. for one year, s\/he may begin the five-year period anew.<\/p>\n<h4>Family of R-1 Visa Holders<\/h4>\n<p>The spouse and unmarried children under the age of 21 of an R-1 visa holder are eligible for R-2 classification.\u00a0 They are not eligible for employment but may engage in study.<\/p>\n<h4>Route to the Green Card<\/h4>\n<p>The R-1 status is also considered a path to a green card through the EB-4 preference: Special Immigrant Religious Worker petition.\u00a0(Click here for more information on\u00a0<a title=\"Fourth Preference EB-4 Permanent Immigration\" href=\"\/en\/practice-areas\/eb-4-green-card-special-immigrants\/\">EB-4<\/a>.)<\/p>\n<p>For more information about this visa category contact us today to schedule a professional consultation with an Immigration Attorney.
